Welcome to Penguin Publishing US. By accessing or using our website at penguinpublishing.us and purchasing any of our publishing services, you agree to be bound by these Terms & Conditions. Please read them carefully before proceeding.
If you do not agree with any part of these terms, you must not use our services.
1. About Our Services
Penguin Publishing US provides self-publishing services including but not limited to:
- Book writing and ghostwriting
- Professional editing and proofreading
- Custom book cover design
- ISBN and copyright registration assistance
- Formatting and typesetting
- Global distribution (Amazon, Barnes & Noble, Kobo, and more)
- Audiobook production
- Book marketing and promotion
2. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information when placing an order
- Ensure that all content you supply (text, images, etc.) does not infringe upon any third-party intellectual property rights
- Respond promptly to requests for approvals and feedback to avoid project delays
- Not use our services for any unlawful, harmful, or defamatory purpose
3. Intellectual Property & Ownership
All original content provided by you remains your intellectual property. Penguin Publishing US does not claim ownership over your manuscript or creative work.
Once full payment has been received and the project is delivered, you retain 100% ownership of your book. We do not retain any publishing rights, royalties, or residual interest in your work unless explicitly agreed upon in a separate written contract.
Any templates, processes, proprietary tools, or methodologies used by Penguin Publishing US remain our exclusive property.
4. Payments & Pricing
- All prices are quoted in US Dollars (USD) unless otherwise stated
- A deposit or upfront payment may be required before work begins, as specified in your package agreement
- Payments are non-refundable once a project phase has been completed and approved by the client
- We reserve the right to update pricing at any time; however, any agreed-upon package price will remain fixed for the duration of your project
5. Refund Policy
We are committed to client satisfaction. Refunds may be considered under the following conditions:
- The project has not yet commenced and a written cancellation request is submitted within 48 hours of payment
- Penguin Publishing US is unable to deliver the agreed services due to internal circumstances
Refunds will not be issued for completed work, approved deliverables, or delays caused by the client's failure to provide required materials or feedback in a timely manner.
All refund requests must be submitted in writing to info@penguinpublishing.us.
6. Turnaround Times
Estimated delivery timelines are provided as a courtesy and are not guaranteed. Delays may occur due to:
- Incomplete or late submission of client materials
- Extensive revision requests beyond the agreed scope
- Third-party platform processing times (e.g., Amazon KDP, IngramSpark)
Penguin Publishing US will communicate any anticipated delays as soon as they become known.
7. Revisions
Each service package includes a defined number of revisions as outlined in your agreement. Additional revisions beyond the agreed scope may be subject to extra charges. All revision requests must be submitted in writing within the timeframe specified in your project agreement.
8. Confidentiality
Penguin Publishing US treats all client manuscripts, business information, and communications as strictly confidential. We will not share your content with any third party without your explicit written consent, except as required to fulfill your publishing services (e.g., distribution platforms).
9. Limitation of Liability
To the fullest extent permitted by law, Penguin Publishing US shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services, including but not limited to loss of profits, loss of data, or loss of business opportunities.
Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
10. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Orlando, Florida.
11. Changes to These Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following any changes constitutes your acceptance of the revised terms.
